Life Science Software Patents: Mobile Health Product Litigation

Team BioCitrxThe mobile health (mHealth) industry has experienced rapid growth in the last few years. As a result, the number of mHealth patents has steadily increased over time with over 20,000 health-related mobile applications (apps) on the market. In contrast with other sectors within the software industry, very few mHealth-related patent litigations have been filed in the United States. However, this is expected to change as the mHealth industry matures. In order to understand the patent landscape and the issues facing the mHealth industry, it is necessary to explore how software patentability and defensibility have evolved over time. There have been extensive discussions regarding the patentability of software due to its intangible and abstract nature. Therefore, several precedent-setting cases will be investigated to elucidate key factors that have led to the growing software patent thicket and their potential implications on the mHealth industry.
